For the first time since the the Mormon Pioneers entered the Salt Lake Valley over 170 years ago, it<\/span> was reported<\/span><\/a>\u00a0in September 2018 that the Emigration Canyon Stream suffered total depletion near the eastern boundary of the Utah State capital city<\/span>\u00a0less than 2 miles from Utah’s Hogle Zoo<\/span><\/a><\/span>.<\/div><\/span><\/h3>\n

Over the past 30 years, Emigration Canyon residents have reported impairment<\/span><\/a> of private wells directly to the Utah State Division of Water Rights (“Utah State Engineer<\/em><\/a><\/span>“) immediately following the completion of\u00a0Boyer Well Nr. 1<\/span><\/a>, Boyer Well Nr. 2<\/span><\/a>, the Brigham Fork<\/span><\/a>, and the Upper Freeze Creek Wells<\/span><\/a>\u00a0by The Boyer Company LC<\/a><\/span> and\u00a0<\/span>Emigration Improvement District (“EID<\/span><\/em><\/a>” aka ECID) operated for the massive expansion of the Emigration Oaks PUD<\/a><\/span> development.<\/span><\/div><\/span><\/h3>\n

The destruction of single-family domestic wells by large-diameter commercial wells\u00a0was accurately predicted <\/a><\/span>by the Utah State Engineer’s office in 1966.<\/span><\/div><\/span><\/h3>\n

The impairment of the Emigration Canyon Stream\u00a0was accurately predicted <\/span><\/a>by EID’s own hydrologist in 1995.<\/span><\/div><\/span><\/h3>\n

In July 2000, EID’s own hydrologist recorded<\/a><\/span> that Boyer Well #2<\/a><\/span> had extracted more water than had been replenished in a good water year (i.e.<\/em>, groundwater mining) but then failed to disclose this fact when it secured $1.8 million of federally-backed funds to construct the Brigham Fork Well<\/span><\/a>\u00a0in the same aquifer.<\/span><\/div><\/span><\/h3>\n

<\/span>Unbeknownst to its water customers,\u00a0<\/span>in September 2015,\u00a0<\/span>EID trustees\u00a0secretly terminated operation<\/a><\/span> of the Brigham Fork Well due to drinking-water contamination<\/a><\/span>.<\/span><\/div><\/span><\/h3>\n

The Purpose of the FCA Litigation Is Twofold:\u00a0<\/div><\/span><\/h1>\n

\u00a0\u2666 \u00a0Relieve Emigration Canyon taxpayers of $6.3 million dollars of federally-backed debt, which the Mayor of Emigration Canyon Joe Smoka<\/a><\/span>\u00a0and EID<\/a><\/span>\u00a0allegedly conspired<\/span><\/a> with land\u00a0<\/span>developers\u00a0R. Steve Creamer<\/span><\/a>, The Boyer Company L.C. and City Development Inc.<\/span><\/a> to fraudulently acquire<\/span><\/a> and then divert<\/span><\/a> in order to build a \u201cpreposterously oversized<\/a><\/span>\u201d water system for the\u00a0massive expansion of the Emigration Oaks PUD<\/span><\/a> as well as over\u00a0500 new residential units<\/span><\/a> at an estimated private profit of $547 million dollars as reported in the Salt Lake Tribune<\/span><\/a>;<\/span><\/div><\/span><\/h3>\n

\u00a0<\/span>\u2666 \u00a0R<\/span>ecover monetary fines, penalties and\u00a0<\/span>unjust enrichment<\/a><\/span><\/span>\u00a0from EID trustees, managers, consultants, publicly-elected officials and private land-developers et al.<\/em> for the endangerment of public health<\/span><\/a> and safety<\/a> <\/span>as well as the destruction of habitat<\/a> <\/span>of a federally-protected species<\/a>.<\/span><\/div><\/span><\/h3>\n
