Dear Mrs. and Mr. Hawkes of the Simplifi Company,

As you are aware, during the trustee meeting of the Emigration Improvement District (“EID” aka Emigration Canyon Improvement aka ECID) on September 10, 2020, the Simplifi Company through Mr. Hawkes confirmed that as operator of water system 18143, Mr. Hawkes “from time to time” manipulated the pressure reducing valves of the system but then refused to elucidate the reasons for taking such unusual and potentially dangerous action.

For this reason, we question the validity and accuracy of the fire-flow tests required for the issuance of building permits in Emigration Canyon and believe notification to the Unified Fire Department may be necessary.

As such, attached herewith is a request for public documents confirmed to be in your custody under the Utah Government Records and Management Act (“GRAMA”) and require an expedited response of 5 days under Utah Code Ann. 63G-2-204 (5), as the documents will be published on the website maintained by the Emigration Canyon Home Owners Association (see e.g. https://echo-association.com/?page_id=1524)
